BKM Travels LLC proudly recognizes and values the essential role of consortiums, independent travel agents, host agencies, and affiliated travel professionals in expanding access to quality travel services and delivering exceptional customer experiences. As part of its commitment to fostering strong industry partnerships, BKM Travels LLC offers a structured commission program designed to fairly compensate the travel agents for qualifying bookings across a range of travel products, including air travel, hotel accommodations, car rental bookings, vacation packages, and group travel bookings.

Our commission framework is built to support long-term collaboration with accredited travel professionals by providing competitive, transparent, and performance-based compensation opportunities. Commissions are generally earned on net eligible bookings after applicable supplier deductions, service fees, and booking conditions, and are subject to individual supplier policies, fare rules, and booking classifications. Eligibility for commission payouts may vary depending on the type of fare, promotional restrictions, booking channel, and contractual agreements with travel suppliers.

BKM Travels LLC is committed to maintaining timely and accurate commission processing in accordance with industry standards, while also ensuring compliance with all airline, hotel, and third-party supplier regulations. This program is intended to incentivize growth, reward booking performance, and strengthen mutually beneficial relationships with the travel agents and independent agencies operating within the travel ecosystem.

5 Net Package Pricing Model

Travel agents may apply uncapped markup on wholesale vacation packages where permitted. Pricing control remains with agent, subject to supplier restrictions.

Vacation Package Commission Notes

Commission Agreement

This Commission Agreement ("Agreement") is entered into by and between BKM Travels LLC ("BKM Travels," "Company," "we," "us," or "our") and any registered or approved travel agent, independent contractor, host agency, sub-agent, or affiliated travel seller ("Agent," "you," or "your").

By accessing, participating in, or receiving commission-based compensation from BKM Travels LLC, you acknowledge and agree to be bound by the terms of this Agreement.


Purpose and Scope

This Agreement governs the terms under which BKM Travels LLC compensates travel agents and independent agencies for qualifying travel bookings, including but not limited to:

  • Air travel bookings
  • Hotel reservations
  • Car Rental Bookings
  • Vacation packages
  • Group travel arrangements
  • Ancillary travel services

This Agreement applies to all commissionable transactions processed through BKM Travels LLC systems, supplier platforms, or affiliated distribution channels.


Commission Eligibility

Commissions are earned only on qualifying, completed, and supplier-approved bookings. A booking is considered eligible for commission only when:

  • Full payment has been received and cleared
  • The booking has been confirmed by the travel supplier
  • The travel service is not cancelled, refunded, or voided
  • The booking is not flagged for fraud, dispute, or violation
  • The booking complies with supplier fare rules and restrictions

BKM Travels LLC reserves the sole right to determine commission eligibility.


Uncapped Markup Facility

Travel agents may be granted access to an uncapped markup facility, allowing independent pricing control over retail fares. Under this structure:

  • Travel agents may set their own customer-facing pricing above net fares
  • BKM Travels LLC is not responsible for retail pricing decisions
  • Profit margins are determined solely by the travel agent
  • Supplier fare rules and restrictions remain binding

BKM Travels LLC may modify or revoke markup privileges at any time without prior notice.


Commission Structure

Commission earnings may include: main commission on flights, hotels, car rentals and vacation packages (BKM Travels LLC paid), bonus commissions (promotional campaigns), and group booking commissions. Commission rates are subject to BKM Travels LLC's policies, fare class restrictions, booking channel rules, seasonal or promotional adjustments, and contractual limitations. BKM Travels LLC does not guarantee fixed commission percentages unless expressly stated in writing.


Payment Terms and Schedule

Commission payments are issued only after supplier commission settlement, travel completion (where applicable), verification of booking validity, and expiry of refund or cancellation windows. Payments are issued on a weekly basis, every Friday, via approved methods including ACH or Wire Transfer only.

Action Required To get commissions released on time, submit the ACH Authorization and W-9 forms, duly filled and signed, to accounting@bkmtravels.com

Deductions and Adjustments

BKM Travels LLC reserves the right to deduct or adjust commissions for refunds or cancellations, chargebacks or disputes, supplier debit memos, fraudulent or invalid bookings, pricing corrections, duplicate bookings, and non-compliant transactions. Travel agents are liable for the repayment of commissions already disbursed for subsequently invalidated bookings.


Clawback Policy

All commissions are subject to clawback rights. BKM Travels LLC may recover paid commissions if the booking is cancelled or refunded, the supplier reverses commission payment, fraud or misrepresentation is detected, a chargeback is initiated, or the booking violates supplier or company agreement. Clawbacks may be executed via offsetting future commission payments, direct debit recovery, invoice issuance to Agent, or legal collection actions. Travel agents remain fully liable for clawback amounts.


Group Booking Commissions

Group travel commissions may be subject to separate negotiated contracts, minimum group thresholds, attrition clauses, supplier-specific payout structures, and delayed settlement timelines. Commission is only payable after full group settlement and supplier confirmation.


Fraud and Compliance Requirements

Travel agents must comply with all fraud prevention and compliance requirements, including accurate customer information submission, valid payment authorization, no manipulation of pricing or bookings, no unauthorized use of payment methods, and compliance with supplier rules. BKM Travels LLC may suspend or terminate commission privileges for suspected fraud or agreement violations.


Right to Withhold Payments

BKM Travels LLC reserves the right to withhold commission payments if a booking is under investigation, fraud is suspected, service payment is pending, documentation is incomplete, or chargebacks are in progress.


Marketing and Pricing Control

Travel agents acknowledge that retail pricing is independently controlled by the agent, BKM Travels LLC does not guarantee customer pricing competitiveness, supplier fare changes may impact profitability, and pricing errors are the Agent's responsibility once published.


No Employment Relationship

Nothing in this agreement shall be interpreted as creating an employment relationship. Travel agents operate as independent contractors and are solely responsible for their taxes, business expenses, licensing requirements, and regulatory compliance.


Limitation of Liability

BKM Travels LLC shall not be liable for lost commissions due to supplier changes, booking cancellations, system errors, payment delays, market fluctuations, or supplier insolvency. Total liability shall not exceed commissions actually earned and approved for payment.


Termination of Commission Privileges

BKM Travels LLC may suspend or terminate a travel agent's participation at any time for policy violations, fraud risk, chargeback activity, misuse of platform, poor performance, or legal or regulatory concerns. Termination does not relieve Agent of clawback obligations.


Audit Rights

BKM Travels LLC reserves the right to audit booking records, commission calculations, payment histories, and agent compliance practices.


Confidentiality

Travel agents agree to maintain confidentiality regarding net fares, supplier contracts, commission structures, internal pricing models, and business operations. Unauthorized disclosure may result in termination.


Dispute Resolution

Any disputes arising under this agreement shall be resolved through binding arbitration in the State of South Carolina under the Federal Arbitration Act. Travel agents waive the right to jury trials, class actions, and collective claims.


Governing Law

This agreement shall be governed by the laws of the State of South Carolina.


Severability

If any provision is found unenforceable, the remaining provisions shall remain valid and enforceable.


Entire Commission Policy

This agreement constitutes the entire understanding between BKM Travels LLC and the travel agent regarding commissions and overrides all prior discussions or policies.


Amendments

BKM Travels LLC reserves the right to modify this agreement at any time. Continued participation constitutes acceptance of updated terms.


Acknowledgment

By participating in the BKM Travels LLC commission program, you acknowledge that you have read, understood, and agreed to this Commission Agreement.
